PLAINTIFFS WIN ANOTHER PREMPRO CASE IN PHILADELPHIA; WYETH LOSES SECOND HORMONE THERAPY DRUG CASE

Philadelphia Jury Returns Verdict That Wyeth’s Hormone Replacement Therapy Caused Breast Cancer and Awards $3.0 Million to Ohio Woman and her Husband

PHILADELPHIA, February 20, 2007 – A state court jury in Philadelphia today found that Wyeth provided inadequate warnings on its drug Prempro and that the hormone therapy drug caused invasive breast cancer in Jennie Nelson, a 67 year old woman from Dayton, Ohio. The jury of nine awarded Mrs. Nelson and her husband $3.0 million in damages. This is the third time in which a Philadelphia state court jury found that Wyeth’s hormone replacement therapy drugs caused a woman’s breast cancer.

“The jurors in this case understood how important it was to evaluate all of the evidence, and to let Wyeth know that dangerous products need adequate warnings,” said Ken Suggs of the law firm Janet, Jenner & Suggs, LLC., co-counsel for Jennie Nelson. “This is the second time in two weeks that a jury has determined that Prempro causes breast cancer. Our jury system will see to it that Wyeth accept responsibility for all of the unnecessary breast cancer it caused.”

Mrs. Nelson’s case was originally heard by a jury in the fall of 2006. At that time, the jury found that her use of Wyeth’s Prempro caused her invasive lobular breast cancer. In 2001, Mrs. Nelson underwent a double mastectomy, chemotherapy and radiation therapy. In October 2006, the jury ruled in Mrs. Nelson’s favor, but Wyeth was later successful in gaining a mistrial on the basis of juror ineligibility.

“Jennie Nelson and her husband Lawrence are very courageous people. They took the lead in representing thousands of women who have developed breast cancer from Prempro,” said Robert K. Jenner, also of Janet, Jenner & Suggs, LLC. “The evidence presented at trial revealed that Wyeth has known for decades that Prempro causes breast cancer. Wyeth chose to avoid testing this dangerous hormone combination and delayed stronger warnings for fear of flagging sales. We hope that this verdict sends a clear message to Wyeth.”

The retrial began on January 11, 2007 in the Philadelphia Court of Common Pleas. The case, which lasted four and a half weeks, was heard by Judge Ricardo C. Jackson.
