Medical
Malpractice - Although
the legal definition may vary slightly from state to state, as a general
rule medical malpractice (also known as medical negligence) means that a
health care provider caused injury or death to a patient by failing to
act within the applicable standard of care.
In other words, a
physician or other health care provider commits medical malpractice and
is negligent when he or she fails to act reasonably under the
circumstances and the unreasonable conduct causes harm.

Pharmaceutical
Negligence / Prescription Drugs / Defective Medical Products -
Lawsuits, in which the foundation is a medication or a defective medical
product. These cases are based on prescription drug recalls, long-term
side effects of prescription medications, product failure, or improperly
prescribed or filled medications.
When an injury occurs and a
lawsuit is filed, the case will be based on personal injury law. These
types of suits typically fall into subcategories such as pharmaceutical
injury law, product failure or medical malpractice/negligence. If a
person dies due to a medication, a wrongful death case may be filed.
Other times, a medication causes serious illnesses or side effects
during its manufacturing, at which time the drug manufacturer is held
accountable. A drug or medical product need not be recalled in order to
hold a company accountable.

Nursing home abuse violations most often include physical or
sexual abuse and abuse from other patients -- with no staff supervision
to prevent this type of behavior. Injuries
