Philadelphia Jury Finds for Plaintiff in first Prempro Hormone Therapy Case in State Court
Case Will Proceed To Second Phase Exploring Whether Wyeth Adequately Warned
Users About the Drug's Risks.
Philadelphia, PA -- October 4, 2006 – In the first state court case, the jury
today found that plaintiff’s use of Wyeth’s hormone therapy Prempro was a cause
of her breast cancer and awarded Jennie Nelson, age 67, $1.5 million in
compensatory damages. The case will continue to a second, or liability, phase
following today's jury decision in Jennie Nelson v. Wyeth, in the Philadelphia
Court of Common Pleas.
Ken Suggs of Janet, Jenner & Suggs, LLC, co-counsel representing Mrs. Nelson
commented, “We are very pleased with the jury’s verdict in Phase I. Clearly, the
medical evidence overwhelmingly showed that Wyeth’s drug Prempro caused Jennie
Nelson’s breast cancer, which required years of medical treatment and undue
suffering for Mrs. Nelson and her family. We look forward to starting the second
phase of this trial which will explore Wyeth’s conduct in promoting and
marketing this drug and Wyeth’s liabilities to Mrs. Nelson.”
The trial, which began on September 13, 2006, was heard before The Honorable
Norman Ackerman.
Currently more than 5,000 cases are pending against Wyeth over the use of
Prempro causing plaintiffs’ breast cancer.
Following the verdict, Robert Jenner, co-counsel
for the plaintiffs, said that the message from this jury is clear: “Drug
companies that make dangerous drugs that cause cancer can’t hide from their
responsibilities. Wyeth refuses to accept the inescapable truth that Premarin
and Prempro cause breast cancer. Its warnings to women and their physicians were
grossly inadequate. This jury’s verdict was the first step in alerting the world
to these real dangers.”
