On December 15, 2004, Robert K. Jenner and John Cord recovered a $2 million settlement for the family of a man in a wrongful death action against Henry's Wrecker Service. The settlement, which occurred mid-way through trial, revealed countless instances of efforts by the tow truck company to cover up and destroy incriminating evidence. Internal company documents revealed an extensive history of maintenance that was both negligent and in violation of state and federal laws. The truck that was involved in the fatal collision suffered from several electrical and lighting problems. The tow truck driver recognized that the truck's rear lights were not working properly, but decided to drive the truck anyway that night. The newly hired tow truck driver negligently parked in the travel lane of the Washington Beltway while attempting to help a disabled driver on the shoulder. The Plaintiff was returning home from an Orioles game and, unable to see the black steel truck until it was too late, slammed into the flatbed and died immediately upon impact.

Witnesses to the collision from Maryland, the District of Columbia, and North Carolina, were located and testified in court that the collision was inevitable because of the poor visibility of the truck. A videotape covered up by the company and discovered in the days before trial revealed an investigation conducted by the company the day of the collision of the truck and scene. This videotape portrayed significant skid marks, demonstrating pre-impact fright that bolstered the conclusions of the Plaintiff’s accident reconstructionist, and showed the defendant's accident reconstruction to have lied under oath.

Most importantly, the widow and adult children of the killed Virginian brought tears to the eyes of the jurors while describing the impact of their loss.
